The White Collar Consult...

Are You Highly Motivated To Receive A Sentence Reduction?

\This week I received many calls from people who have recently been arrested or indicted with Federal crime. The calls we have received have all centered around securities fraud, tax fraud, healthcare fraud, and PPP fraud. These are all serious crimes and the risk of spending time in prison as a result of committing these crimes is very high When I get calls from potential clients there is always a tremendous amount of anxiety and fear. I understand this, I was there myself. Several of these people later said they decided at the advice of counsel to decide not to use our services, we understood.  I am looking for a certain type of client. I am looking for a client that is proactive and highly motivated to do whatever they need to do to possibly receive a sentence reduction. When I discuss my program with a potential client there is always a lot of initial excitement about the possibility of doing mitigation work. Most people in this position are interested in doing whatever they can to get a reduced sentence. What I have realized recently is our program is not for everyone. Our program requires a lot of work to put our clients in a position where the decision-makers in their case can get an understanding of who they are apart from their crime. No program is the same for one client. Our service is providing a personal sentence mitigation product to our clients. I take this work seriously. Many of the clients we represent are facing long prison sentences that can destroy their future and the future of their families. We have seen cases where defendants have done significant mitigation work where a judge has departed from the guidelines on some occasions we have seen probation.

From a personal narrative, character reference letters, working a new job, paying restitution, community service, and recovery work(if needed) these are just a few things you can do to recreate your life. Judges want to know what have you done since your arrest. You need to give a reason to a judge why he should consider departing from the guidelines. As I said, I take my services very seriously, I have been arrested and seen charging documents with my name on them with guidelines of 100 months in prison. I have done extensive personal mitigation work that brought me from a potential sentence of  9 years to home confinement. If you are proactive and highly motivated to receive a sentence reduction you are our ideal.

I have a client who is getting sentenced in 3 weeks and has worked tirelessly to recreate his life. My team has done extensive work with him the past week to prepare for sentencing . When he is sentenced later this month, I don’t know if he will receive a departure, but I do know hell to be able to tell himself there was nothing more he could have done for himself and his family.  At your sentencing will you be able to say that?
