How can your client qualify for the Residential Drug and Alcohol Program? To qualify for RDAP your client must disclose substance abuse at their pre-sentencing interview. The substance abuse must occur within 12 months of their arrest. The program is 500 hours long and is very intense. If your client completes RDAP they may qualify for as much as a 1-year reduction in their sentence and in addition, they may qualify for as much as 6 months in a halfway house. Besides cooperation, this is one of the only ways that a defendant can get a significant sentence reduction so if they qualify make sure this information is documented in the pre-sentencing report. A judge cant sentence you to RDAP they can only recommend it, and in most cases, they will not recommend the program unless it is documented in the PSR.
